Corkman barred from Galway city and county for calling garda abusive name
A 20-years-old Cork man who came to Galway to celebrate Hallowe'en with friends and became very abusive to a garda outside a city centre night-club, has been barred from the city for two years following his appearance before Galway District Court this week.

Daniel Dwyer (20), Knockleigh, Belgooley, Cork, pleaded guilty to breaching the peace and being drunk in public at Abbeygate Street, Galway, in the early hours of October 31 last year.

Inspector Pat McHugh said Garda Claire Burke was outside Halo night-club when the accused came out of the premises in a very intoxicated state. He walked into the garda and she went to arrest him for being drunk and a danger to himself and others in public.

Dwyer took umbrage at being arrested and shouted abuse at Garda Burke, calling her all sorts of names, the inspector said.

Defence solicitor Valerie Corcoran said her client had a very low tolerance for alcohol and it did not agree with him. She said he might not drink for a few months but would then drink too much. His family, she said, was assisting him overcome his problem.

Describing the accused as "an avid golfer", Ms. Corcoran said her client was of impeccable character when not drinking and he wanted to apologise for his behaviour on the night.

Hearing Dwyer had four convictions for public order related offences, Judge Mary Fahy said he had been getting into trouble in Cork and had come to Galway where he also got into trouble.

Judge Fahy warned the accused that if he continued to behave in the way he had behaved towards Garda Burke, he would be going to prison. Calling the garda names, she said, had been outrageous.

She sentenced Dwyer to two months in prison for breaching the peace but suspended it on condition he stay away from Galway city and county for the next two years.

She also imposed a fine of € 400 for breaching the peace and a further € 100 for being drunk in public.

Corkman went to the toilet in top hotel kitchen

A drunken Cork man went to the toilet in the kitchen of a four-star Galway hotel after eating € 30 worth of desserts and then caused nearly € 800 of damage to the area before being caught by staff.

Hotel guest Andrew Cuffe (25) 8 The Bride, River Valley, Mallow, Co Cork, pleaded guilty at Galway District Court yesterday to trespassing in the kitchens of the top hotel where he stole food and damaged a stereo and staff lockers, on January 8 2005.

Inspector Pat McHugh told the court Cuffe, who had been staying at the 4-star hotel as a guest, had returned there at 1am and gone into the kitchens where he ate a tray of desserts which had been left out. He then damaged a stereo and bent locks on staff lockers before going to the toilet in the kitchen area.

Staff noticed this mess when they came to investigate and Cuffe later admitted to Gardai that he had been the culprit.

Inspector McHugh said total damage caused amounted to € 760, which included a specialist cleaning bill of € 80.

Defence solicitor Valerie Corcoran said her client has been battling an alcohol addiction with the help of the probation service and the AA in Cork and had been off drink for nine months prior to this relapse. He had come to Galway for the weekend with a friend who was paying for their stay in the upmarket hotel, she said.

Ms Corcoran said her client had relapsed and gone binge-drinking on this occasion. She said he was delirious from drink and had no recollection of what he did. His father was in court and would pay compensation as her client was not working, she added.

Ms Corcoran handed € 760 cash compensation into court on behalf of her client.

Judge Mary Fahy said Cuffe's behaviour was totally unacceptable. "Using a kitchen as a toilet facility - it beggars belief," the judge said, before imposing a € 500 fine.

A hotel barman will have to undergo a second operation to straighten his nose because the first operation failed, after he was hit by a drunken labourer whom he refused to serve.

Sentencing Edmund O'Flaherty, 73 Binn Bhán, Western Distributor Road, Salthill, to a total of 13 months in prison for the assault on Great Southern Hotel barman, Padraic Gormally, and for a less serious assault on a doorman at O'Flaherty's pub at the hotel, Judge Mary Fahy said the accused would have been sentenced to a few years in prison if the case had been heard in a higher court.

Garda John Maloney told Galway District Court this week that he was parking his car near Victoria Place on July 22 last when he noticed two men scuffling on the ground. He separated them and one man told him he was a security guard at the bar at the Great Southern Hotel. The other man was O'Flaherty, who was very intoxicated and aggressive.

Garda Maloney said he discovered O'Flaherty had hit barman Padraic Gormally into the face with his clenched fist moments before and had then fled the bar, but had been followed by doorman Vaiddas Serpytis and a fight had ensued between them at Victoria Place.

Mr Gormally told Judge Mary Fahy he had to have an operation on his nose following the assault but it was unsuccessful and he would need to have a second operation to straighten it. He said he had difficulty breathing through his nose and had to take six weeks off work at the time to recover.

Defence solicitor Claire Prendergast said her client was pleading guilty to both assaults and to associated public order offences. She said he had been put on medication for panic attacks following an accident at work in 2003. The medication had been altered a week prior to this incident and she believed the alcohol her client had consumed on the evening in question did not agree with the medication.

Garda Maloney said O'Flaherty had a previous conviction for assault in January 2003.

Ms Prendergast said that offence occurred one week after her client had been first put on the medication. She asked Judge Fahy to adjourn sentencing until she could furnish a psychiatric report to the court.

Judge Fahy said this had been a very serious assault on Mr Gormally who would now have to undergo a second operation.

Given O'Flaherty's previous conviction for assault, Judge Fahy said she would have to deal with the matter immediately. She sentenced O'Flaherty to 10 months in prison for assaulting Mr Gormally, causing him harm and she sentenced him to a further three months, to run consecutively, for the lesser assault on Mr Serpytis. A further one-month concurrent sentence was imposed for breaching the peace and € 100 for being drunk. Leave to appeal was granted.

Parked car took brunt of Loughrea man's frustration with friends

A Loughrea mechanic vented his frustration and kicked a parked car causing more than € 400 of damage following a row with friends outside a night-club in Galway city last year.

Martin Lohan, Mount Carmel, Loughrea, pleaded guilty at Galway District Court this week to causing € 425 worth of damage to a car parked at Market Street, Galway, in the early hours of February 19 last year.

Inspector John Galvin told the court the accused and a group of friends had been arguing outside a night-club and as gardai approached they heard glass breaking. It transpired that Lohan had kicked a parked car while arguing with friends and the cost of repairing it was € 425.

Defence solicitor Adrian MacLynn said his client was in a night-club with a friend who got into an argument with another friend and his girlfriend. Everyone was ejected except his client who followed the others outside. As he intervened to stop his friends from fighting his friend's girlfriend turned on him and in sheer frustration he kicked out at a car parked nearby.

Mr MacLynn said Lohan had € 400 compensation in court which was accepted by Sergeant Willie Byrne on behalf of the car's owner.

Inspector Galvin said Lohan had previous convictions for two public order offences.

Judge Mary Fahy convicted and fined Lohan € 300 for causing the criminal damage.
